Nature of the project and intellectual property
New Xenesis is a fan-run private server. TERA and related marks belong to Bluehole Studio Inc., KRAFTON Inc., and their respective owners. This site is not affiliated with or endorsed by them.
Community-authored copy and site design are described here for information only. Nothing in this draft transfers rights in the official client or in third-party intellectual property.
Software licence
Any launcher, patches, or tools distributed by the project would be licensed for personal, non-exclusive use limited to connecting to this server. Redistribution, unlawful reverse engineering, and commercial exploitation are not granted. The original client remains subject to its owners’ terms.
Payments and refunds
Voluntary contributions mentioned on the site (if ever enabled) are not a sale of goods and do not form a paid contract until a reviewed legal framework exists. This draft does not authorise charges. When payments exist, currency, payment provider, invoicing, and refunds (deadlines, exclusions, claims channel) must be stated. Until then, there is no refund right and no duty to pay.
Account ownership and suspension
An account is a means of access, not transferable property. You must keep credentials confidential. The operator may limit, suspend, or close access for rule breaches, abuse, cheating, impersonation, or security risk, under procedures published when registration goes live.
Changes and discontinuation
The project may change these terms, the software, or the service, or stop it in whole or in part, with reasonable notice given the launch stage. Continuous availability and a minimum term are not guaranteed.
Controller details
Intended controller and publisher: the New Xenesis team. Legal name, address, and official contact will replace this paragraph before registration or any charges go live. Until then, support and Discord contacts are operational only and do not substitute a formally designated controller.
Anticipated account data include account name, email, and credentials. Retention, processors, and access, rectification, and erasure rights must be defined with legal advice.
Governing law
Unless mandatory law says otherwise, relations arising from this site will be construed under the law of the operator’s establishment, to be named when known. Competent courts will be set in the reviewed version of this document.
